Hold a public hearing to consider a protest of a minor wireless permit and uphold the Director of Public Works' decision.

BACKGROUND
On August 12, 2018, City staff held a pre-application meeting with Modus, Inc., working on behalf of AT&T Mobility, for installation of a wireless communications facility (small cell) on a utility pole within the public right-of-way at 201 North Amphlett Boulevard. As required by the San Mateo Municipal Code (SMMC) 17.10, "Wireless Communications Facilities in the Public Right-of-Way", Modus, Inc. mailed notices to nearby residents for the opportunity to have an informational neighborhood meeting. Such a meeting was requested and held on October 11, 2018 at the Martin Luther King Community Center. The meeting included photo simulations, a scaled three-dimensional mock-up of the installation, and responses to questions posed by attendees.

A formal Wireless Communications Facilities Permit Application was submitted on November 8, 2018 by Modus, Inc. on behalf of AT&T Mobility. Based on the review of all the submitted documents, staff determined that the application and proposed installation meet the required conditions of approval as outlined in SMMC 17.10.070(a). Conditional approval of the application was given on January 8, 2019. As required by the SMMC 17.10.060, a notice was mailed on January 10, 2019 to residents within a 500-foot radius of the proposed location and posted at the site. The notice advised residents of the Director of Public Works' (Director's) decision and allows a 10-day protest period.
